1. Subject of the License Agreement
The subject of this license agreement (hereinafter the Agreement) is the right to use one licensed copy of the software product Sypex Dumper Pro (hereinafter the Software Product), in the manner and under the conditions established by this Agreement. If you do not agree to the terms of this Agreement, you may not use this Software Product. Installation and use of the Software Product means your complete agreement with all provisions of this Agreement.
2. Copyright
2.1. The software product Sypex Dumper Pro is the intellectual property of BINOVATOR company (hereinafter the Copyright Holder).
2.2. The Software Product is protected by the law of Ukraine "On Copyright and Related Rights", as well as international agreements.
2.3. Property rights and copyright include source codes, texts, images and other copyright objects.
2.4. In case of copyright infringement, liability is provided in accordance with applicable law.
3. Scope of Rights Granted by this Agreement
3.1. This Agreement grants you the following rights:
3.1.1. The right to install and use one copy of the Software Product on one domain name;
3.1.2. The right to make a copy of the Software Product, provided that this copy is intended only for archival purposes and to replace a lawfully acquired copy in cases where the original is lost, destroyed or has become unusable. This copy may not be used for other purposes and must be destroyed if possession of the Software Product copy ceases to be lawful;
3.1.3. The right to receive updates of the Software Product via the Internet;
3.1.4. The right to create applications whose interface will work successfully with the Software Product and which do not affect the source code of the system, indicating that this is your original product;
3.2. In accordance with the terms of this Agreement, you do not have the right to:
3.2.1. Modify the Software Product, use its components in any other products;
3.2.2. Transfer to other persons the rights granted to you by this Agreement (by rental, lease or temporary use);
3.2.3. Remove or modify any proprietary and copyright notices in the Software Product;
3.2.4. Distribute the Software Product or individual copies of files, libraries and other source code of the product;
3.2.5. Modify the Software Product to operate one set of source files simultaneously on multiple Addresses (URLs, domains, subdomains, etc.). A separate license is required for each site;
3.3. This Agreement does not grant you any rights with respect to trademarks or names belonging to the Copyright Holder.
3.4. This Agreement does not grant the right to receive a new version of the Software Product free of charge.
4. Term of the Agreement
4.1. This Agreement and the rights granted by it come into force at the time of installation of the Software Product and are valid for the duration of the license.
4.2. Without prejudice to any of its rights, the Copyright Holder has the right to terminate this Agreement if you fail to comply with its terms and restrictions.
4.3. Upon termination of this Agreement, you must destroy all copies and components of the Software Product in your possession.
5. Liability of the Parties
5.1. The Copyright Holder guarantees that the operation of the Software Product will comply with the description given in the documentation.
5.2. The Copyright Holder bears no responsibility in case of incompatibility of the Software Product with your server.
5.3. The Copyright Holder is not liable for any damage related to the use or inability to use the Software Product.
5.4. For violation of copyright on the Software Product, the violator bears civil, administrative or criminal liability in accordance with the law.
5.5. In case the user changes the source code of the Software Product, the Copyright Holder does not guarantee uninterrupted operation of the program.
5.6. Due to the absence of a license term, refund is not provided by this Agreement.
6. Content
6.1. The Copyright Holder of Sypex Dumper Pro reserves the right to publish lists of selected clients of its Software Products.
6.1.1. In order to be included in the client list, your project must meet the following requirements:
- a copy of the Software Product must be legally purchased from the Copyright Holder of the product.
- your project must display the Sypex Dumper Pro logo, with a description that this is a licensed copy and a link to the official website of the Software Product, or a page on the official website with a description of your system.
6.1.2. Your website must not contain content prohibited by law.
6.2. The Copyright Holder of Sypex Dumper Pro reserves the right to change the terms of this license agreement at any time, but such actions do not have and will not have retroactive effect. A copy of this license agreement and its changes will be available on the official website of the Software Product, at https://sypex.net/en/agreement/
